Official Rules
The Parker Reese Foundation presents the drawing of a 3 bedroom 3 bath townhome, located at 1 Vauxhall Place, Chapel Hill, North Carolina 27517. The actual drawing is intended to be held on February 27, 2010 at 12:00 pm, however the Foundation reserves the right to extend the date until such time as all the tickets are sold. See the website for the official drawing notification: www.cdhhouseraffle.com. The drawing will be held at 5115 Dairyland Road, Hillsborough, North Carolina 27278 on April 24,2010 at 2:00 p.m. EST. Winner need not be present to win. The Official Rules of the drawing are set forth herein. By entering the drawing, all entrants agree to be fully and unconditionally bound by these Official Rules, waive any right to claim ambiguity in the drawing or these Official Rules and further agree to be bound by The Parker Reese Foundation's decisions and interpretation of these Official Rules. By entering, all entrants release The Parker Reese Foundation, participating sponsors and any of their parent companies, subsidiaries, affiliates, directors, officers, employees and agencies from any liability.
ELIGIBILITY: Drawing open only to persons age 18 or older at the time of entry to purchase tickets, be a ticket holder or win a prize. An affidavit of eligibility, photo identification, and other information will be required from prize winners. Void where prohibited. This is not a lottery, this is drawing by chance. All applicable federal, state, and local laws and regulations apply. The Parker Reese Foundation is obligated to report the value of the prize to tax authorities as income. No mechanically or electronically reproduced entries accepted. The following individuals, and immediate family members of The Parker Reese Foundation (defined as spouse or IRS dependent) of, and/or any person who reside in the same household as, any in any of the following categories, are not eligible to participate: * Employees of The Parker Reese Foundation. * Any person who resides in any area where this drawing, game by chance, would otherwise be prohibited by law.
HOW TO PURCHASE: To enter, a ticket can be obtained at the following internet website: www.cdhhouseraffle.com. Purchaser must provide full legal name, home phone, alternate phone, physical mailing address, mailing address. Tickets and payment confirmation will be provided electronically at time of purchase. Ticket purchases are not tax deductible in accordance with IRS regulations. All sales are final unless otherwise specified in these official rules. The Parker Reese Foundation will reject any drawing ticket request if the check or credit card payment is not honored or is returned due to insufficient funds or any other reason prior and not remedied before the time of drawing. Correction of any such return or non-payment is the sole responsibility of the ticket purchaser. Odds of winning depend on number of eligible entries received. All federal, state and local taxes associated with receipt or use of prize, including without limitation all applicable sales, use, luxury, income and special taxes are the sole responsibility of the winner. Winner must claim prize with The Parker Reese Foundation and sign and deliver a completed W-9 form, completed certification by Raffle winner form, or other form as required by law, to The Parker Reese Foundation no later than 5:00 p.m. EST thirty (30) calendar days from announcement or first attempt to contact, or the prize will be forfeited and awarded to an alternate winner, see section (4). Prize non transferable. No entrant need be present to win. Winner determined by random drawing from all eligible entries, to be held by The Parker Reese Foundation, which will notify winner by telephone or email and U.S. certified mail return receipt on drawing day. To claim prize, winner must follow the instructions contained in their notification. Winner must present proper ID, a valid state-issued driver's license or identification certificate. See section 4 below. The Parker Reese Foundation reserves the right to disqualify false entries or entries suspected of being false, and any illegible, defective, incomplete or physically altered entry forms and entries that do not include valid or complete payment. The Parker Reese Foundation is not responsible for printing errors in any drawing-related material, or for lost, late, misdirected or non-delivered mail, or any other failure to receive orders or deliver receipts prior to the drawing deadlines. All entries become the property of The Parker Reese Foundation and will not be returned.
SELECTION OF WINNERS: Drawing. One (1) random drawing will be conducted for each prize by a representative of The Parker Reese Foundation, as described below. Entrants need not be present to win. All tickets will be verified and selected by a representative of the foundation. The winning ticket will be drawn at 104 Glenwood Avenue, Raleigh, North Carolina 27603 from all eligible ticket requests received. Winner name, not ticket numbers, will be called. The winner will be called by name and verified by matching the ticket with the information provided in the records. All winners will be notified by telephone, email or certified mail, return receipt requested based on the information provided at ticket purchase. Notification by telephone will be made day of drawing. Email or U.S. certified mail, return receipt notification will be made within 24 hours of drawing.
DRAWINGS: Tickets must be purchased at least 12 hours prior to the drawing to insure entry. PRIZE: The Grand Prize is a 3 bedroom, 3 bath townhome home vlaued at $240,000 located at 1 Vauxhall Place, Chapel Hill, North Carolina 27517. A minimum of 75,000 tickets must be sold in order to have the raffle drawing of the grand prize (House), 2nd prize ($50,000), and 3rd prize ($25,000). A maximum of 80,000 tickets will be offered. In the event that 15,000 tickets are not sold by the drawing date the Foundation will issue the Grand Prize winner a sum equal to 50% of the Net Raffle (not to exceed the value of the home) and the 2nd and 3rd prizes will be negated.
The Parker Reese Foundation will assume all costs associated with the deed transfer of the Prize Home in accordance with North Carolina law. A W-9 form must be completed by the winner. Any withholdings if required, applicable to prize will be required at the time of transfer of such prize to the winner. The winner will be liable and must assume any other expense in owning the Home, including without limitation, property taxes and homeowners association fees. No warranties, express or implied, are made or offered by The Parker Reese Foundation. The PRIZE HOME is provided "as is", with no guarantees or warranties from The Parker Reese Foundation or any other individuals or entities associated with this drawing. Winner is advised to consult a professional tax advisor. Home interior decorating and furnishings and artists renderings are for display purposes only and are not included as part of the Prize. Custom choices and upgrades are not available. Tax authorities may place a different value on the home for the purpose of determining any income, property, transfer, or other taxes that may be due from the Prize winner. If any prize winner cannot be located by 5 p.m., thirty (30) calendar days after the announcement or thirty (30) days after prize notification, whichever is greater, or if the winner deemed to be ineligible, such a winner will be deemed to have forfeited his/her prize and another winner will be selected for such prize. The winner will be posted approximately 48 hours after the final drawing and may be obtained by visiting www.cdhhouseraffle.com Requests in writing must be received or postmarked within seven days of the drawing and include a self-addressed, stamped envelope. The IRS has decided that amounts paid for chances in raffles, lotteries, or similar drawings for prizes are not gifts, and do not qualify as tax deductible charitable contributions.
NOTIFICATION: Entrant whose ticket number is drawn at the Prize drawing for the home and cash prizes will be deemed the winner of the prizes ("Selected Entrant"). Selected Entrant will be notified by phone and/or U.S. mail using the information provided on the Entry Form or ticket ("Notification"). If any Selected Entrant cannot be located or fails to return attempts to contact him/her by 5:00 p.m. thirty (30) days after The Parker Reese Foundation's first attempt to contact him/her, such Selected Entrant will be deemed to have forfeited his or her prize and another Selected Entrant will be drawn. Each Selected Entrant must execute an affidavit of eligibility/liability/terms and conditions/publicity release ("Release"). Selected Entrant(s) must provide all information requested to be eligible to win, including proof of age, proof of identity showing that the person claiming the prize is the same entrant named on the winning ticket or credit card used to purchase the ticket. Unless restricted by law, each Selected Entrant will be required to complete and return the Release within thirty (30) days of prize notification. The prize may be forfeited if Selected Entrant(s): (1) cannot be reached; (2) fails to obtain all signatures on the Release and to return documents in a timely manner as required pursuant to these Official Rules; or (3) cannot accept or receive prize for any reason. Transfer of deed, title and possession of the property will be 90 days from the date of notification to the winner. Winner must execute all required documentation to transfer title of property into his or her name, within the one hundred eighty (90) days of prize notification. Winners grant permission for the use of their names, photographs/likenesses for advertising and promotion for this and similar promotions without compensation, unless prohibited by law. In the event any Selected Entrant is found ineligible or forfeits the prize, as described in these Official Rules, an alternate drawing will be held within five (5) business days after verification. If the Selected Entrant is found ineligible by the Foundation, rules of alternate drawing governed by these Official Rules, and notification will be posted on the website immediately. The Foundation and its affiliates expressly reserve the right to modify the rules and regulations of this drawing by posting such notice on the raffle web site.
GENERAL TERMS AND CONDITIONS: By entering the drawing, the entrant agrees to be bound by these Official Rules and the decisions of The Parker Reese Foundation shall be final. Winners will be required to execute an affidavit of eligibility and a publicity release permitting The Parker Reese Foundation to use their name, photograph, likeness, and voice for promotional purpose in any media. All winners are required to present proof of identity satisfactory to The Parker Reese Foundation's sole discretion that matches the name on the winning ticket. Neither The Parker Reese Foundation, its employees, founders, owners, investors or any sponsor or any of its subsidiaries, affiliated companies, franchisees, service agencies, officers, directors, shareholders, members, representatives, or independent contractors or any of its affiliates are responsible for any injuries, losses or damages of any kind arising in connection with or as a result of the winner's acceptance or use of any prize. Winner agrees to defend, indemnify and hold The Parker Reese Foundation, and/or sponsors and each of their respective officers, directors, shareholder, employees, agents and affiliates and identities, harmless from any and all losses, damages, rights, claims, and actions of any kind arising in connection with or as a result of the winner's acceptance or use of the prize.
PERSONAL INFORMATION COLLECTED BY The Parker Reese Foundation WILL BE USED FOR ADMINISTRATION OF THE DRAWING. The Parker Reese Foundation WILL NOT SHARE, SELL, OR OTHERWISE DISTRIBUTE PERSONAL INFORMATION COLLECTED BY SPONSOR EXCEPT AS STATED ABOVE. THIS DRAWING IS VOID WHERE PROHIBITED BY LAW.
